Apprehended Violence Order (AVO)

You may have heard of it, you may already have one placed, yet you will never understand the seriousness of AVO.

You are right, AVO itself is not a criminal record or conviction – merely an Order of the Court. So, you may think that since the AVO is simply an Order, there is no harm or risk in consenting to the AVO being made or even breach it for one reason or another. How wrong could you be?

If you simply accepted the AVO without seeking proper legal advice then you may find yourself in an awkward position that you never anticipated. You might be forced to move out of your house. You might be prevented or restricted from seeing your children or going to or near a particular location. If you simply believed your innocence and ignored the AVO, you will face dire consequences.

If you breached AVO on whatever ground, this is deemed to be a criminal offence and the police have powers to arrest (without a warrant) and charge you and bring you before the courts as soon as is practicably possible. Depending on the seriousness of the breach you may or may not be granted bail, with a maximum penalty of 2 years imprisonment and or a fine up to $5,500.00.

And it is easy to make an AVO against you, a simple telephone call to police, with a claim that you swore at, intimidated, harassed or any other dubious grounds are sufficient to have arrested and send to in front of a Magistrate.
